MPower Partner Forum: Meeting the Demands of the Occupational Safety and Health Standards Law

On December 6, 2018, the Department of Labor and Employment (DOLE) signed Department Order No. 198 (see copy here), which details the implementing rules and regulations (IRR) of Republic Act No. 11058, entitled “An Act Strengthening Compliance with Occupational Safety and Health Standards and Providing Penalties for Violations Thereof”. The Act specifies standards for a safe and healthy workplace; and non-compliance to these standards would entail daily penalties ranging from Php 20,000 to Php 50,000, depending on the administrative violation.

By the end of this 3-day workshop, participants are expected to:
  • Enumerate the coverage of R.A. 11058;
  • List the scope of the Labor Standards Law Compliance Assessment Checklist; and
  • Write a health and safety program as required by D.O. 198-18.
 
Day 1 of the workshop (12 Feb) will entail an orientation on R.A. 11058 and D.O. 198-18, a discussion on the Labor Standards Laws Compliance Assessment Checklist, an open forum and breakout sessions. On Day 2 (13 Feb), participants will meet with the Health and Safety (H/S) Committees of their organizations to discuss the actual status of their company’s H/S programs based on what was completed on Day 1. Any conflicts, loose ends, and concerns arising from the meeting are to be discussed during the breakout sessions on Day 3. On the third and last day of the workshop (14 Feb), resource persons will help finalize the design of the participants’ H/S programs and prepare the required DOLE reports relevant to the discussion. Participants will also present their accomplished H/S programs on this day.
